Terms of Service.

Shipping.

We currently only ship orders within the United Kingdom mainland. Shipping fees are calculated and clearly displayed at checkout. Here are some other important points to note:

  • domestic orders in the UK normally ship between 7-14 days;
  • we currently don’t ship internationally, only UK mainland;
  • shipping times may vary on exclusive drops and pre-order items; and
  • if you refuse a shipment from us you are responsible for the original shipping charges, plus any additional courier fees.

Terms of sale.

These terms of sale apply when you use our website (the “website”) or apps to purchase our products. By purchasing any poduct from the website you confirm you agree to these terms of sale. These terms of sale apply alongside any specific terms and conditions applicable to any products.

The website is operated in the United Kingdom by Never Sink Limited and registered in Scotland under company number SC857371 with its registered address at 15 Chalmers Street, Chalmers Street, Dunfermline, Scotland, KY12 8AT. Everything you need to know about us and the products we sell can be found on the website. If you purchase products from us we will confirm all the necessary information to you on your device prior to completing your transaction, and we will also email you full details of your order.

Order confirmation.

Orders are not accepted until they are confirmed by us. Once we have accepted your order, we will send you an email to confirm we have accepted. Please note that until you receive a confirmation email that we have accepted your order, it is not confirmed.

Product pricing.

We will set, at our sole discretion, the price payable for all our products. These prices and amounts can be varied by us at any point. Please check the relevant order page prior to completing the checkout process for the price payable for your order.

We can reject an order.

Sometimes we need to reject orders, which may come before or after we have confirmed them. Some of the reasons that we may need to reject an order include:

  • unexpected supply issues with stock;
  • we have been unable to verify your age for age-restricted items;
  • you live out with the United Kingdom mainland; or
  • the price of a product was mis-stated by us.

When this happens, we will advise as soon as possible and fully refund any sums you have paid, if any.

The checkout process.

We will take payment for all orders at the point you complete the checkout process for your full order. You will own your ordered goods once we have received payment in full.

We pass on VAT changes.

If the rate of United Kingdom VAT changes between your order date and the date we ship your order, we adjust the rate of VAT that you pay, unless you have already paid in full before the change in the rate of VAT takes effect.

Delays we cannot control.

In the unlikely event that the supply or sale of a product is delayed by an event out with our control, for example, natural disasters, inclement weather, fire, war or a pandemic, we will aim to contact you as soon as possible to let you know about the delay. In the event that there is a delay we will do what we can to minimise it. As long as we do this, and remain fully transparent throughout, we won’t compensate you for the delay. However, if there is a substantial delay please contact us at hype@neversink.co.uk to discuss options on how we can resolve the delay.

Products can vary slightly from their picture.

We do everything to ensure that images of our products on our website are accurate. Some products or their packaging may differ slightly from how it is displayed on your device.

You can change your mind, but there are limits.

For most of the products bought on our website, you have a legal right to change your mind and receive a refund the amount you paid for it. This is subject to some conditions, as set out below. You cannot change your mind about an order for:

  • products sealed for health protection or hygiene purposes, once these have been unsealed after you receive them;
  • sealed audio or sealed video recordings or sealed computer software, once these products are unsealed after you receive them;
  • products that are produced as print on demand;
  • products that are made to your specifications or are clearly personalised; or
  • products which become mixed inseparably with other items after their delivery.

If you change your mind about a product you must let us know no later than 14 days after the day we deliver your product. If the goods are split into several deliveries over different days, the period runs from the day after the last delivery. Our clothing items are print on demand, so to reduce unwanted items we encourage you to make certain what you order. We will only refund you if the item is faulty or damaged, and you are liable for all costs to return your items.

You have to return items at your own cost, and we will only refund you if the item is faulty or damaged.

You have to return any products, and any free gifts provided with it, to us within 14 days of you informing us you have changed your mind. Returns are at your own cost, unless we told you we were going to be offering free returns when you bought from our website. You can send the product back to us using an established and reputable delivery service. If you do this please keep a receipt or other evidence from the delivery service that proves you have sent it and when you sent it. If you don’t do this and we don’t receive the goods at all, or within a reasonable time, we cannot refund you for the purchase.

Delivery timeframes.

We will, where possible, give you an estimate of the likely timescale in which we will deliver your products to you. We make every effort to deliver all products within our estimated timescales. However, delays are occasionally inevitable due to unforeseen factors or events out with our control, for example, material shortages, travel or transportation disruption, or demand that we anticipate for a certain product. We shall not be liable for any delay or failure by us to deliver your products within the estimated timescales as a result of such delays. Refused deliveries.

If delivery of a product is refused by you and returned to us, you are responsible for all return shipping costs. These costs will be deducted from any refunded amount. Please note, we only refund standard delivery costs, we do not cover any premium delivery fees you may have incurred.

When to expect a reduced refund.

If you handle a product in a way which would not be acceptable in a store, we will reduce your refund, to compensate us for its reduced value. For example, we reduce your refund if the product’s condition is no longer “as new”, tags have been removed, the packaging is damaged or accessories are missing. In extreme cases, due to the way you have treated the product, no refund may be due. Please email hype@neversink.co.uk and we can advise you on whether we’re likely to reduce your refund.

When and how we refund you.

We absolutely agree that there are valid reasons you would require a refund. If your order has not yet been delivered, we will refund you as soon as possible, and within 14 days of you telling us you’ve changed your mind.

If your order has been delivered and you are sending it back to us, we will refund you within 14 days of receiving the relevant physical products back from you. When urgent, or appropriate to do so, we will refund you if you can provide evidence you’ve sent your order back to us.

We issue refunds by the method you used for payment. We don’t charge a fee for a refund.

You have rights if there is something wrong with your product. If you believe something is wrong you should contact us by email at hype@neversink.co.uk right away. We honour our legal duty to provide you with products that are as described to you on our website and that meet all the requirements imposed by law. These are subject to certain exceptions. We can change our products.

We can change our product range at any time. This may be to reflect current styles, trends or to meet with UK laws and regulatory requirements. Prices may, therefore, be altered accordingly for any future product purchases on our website. Sometimes we may need to make small technical changes to our products, for example to address a manufacturing or quality defect. Minor changes are very unlikely to alter the overall use of the product.

We can withdraw any of our products at any time.

We will always let you know, as soon as possible, if this is going to happen and we will aim to refund any sums you’ve paid in advance for products which won’t be provided.

We can end a contract.

While extremely rare, we can end a contact with you, and claim compensation from you if:

  • you don’t make any payment to us when it’s due and you still don’t make payment within 7 days of our reminder that payment is due;
  • you don’t, within a reasonable time of us asking, provide us with information, co-operation or access that we need to provide a product, for example, accurate email address or payment information;
  • you don’t, within a reasonable time, either allow us to deliver the product to you or collect it from us; or
  • you breach any applicable third party terms and conditions that may apply to the product.

Commercial resale.

Our products are sold for personal, non-commercial use only unless we have a formal partnership agreement with you. By purchasing from us, you agree not to purchase, use, market or distribute our products for commercial resale or other commercial purposes without our prior written consent. We reserve the right to refuse, limit or cancel any order that we believe, in our sole discretion, is intended for commercial resale. Any individual or entity found to be engaging in unauthorised commercial resale of our products and may face order cancellation or legal action. This includes seeking the suspension or removal of unauthorised listings or website that display, sell or promote our products without our permission.

We don't compensate for your loss.

We are not responsible for losses you suffer caused by us breaking these terms of sale unless the loss is:

  • unexpected and was not obvious that it would happen. Nothing you said to us before we accepted your order meant we should have expected it and therefore your loss was unforeseeable;
  • caused by a delaying event out with our control, as long as we have taken the steps outlined in the delivery timeframes section. We are not responsible for delays out with our control;
  • avoidable by taking reasonable action to avoid your loss, for example, following our care instructions on the product; or
  • a business loss relating to your use or purchase of a product for the purposes of your trade, business, craft or profession.

Resolving disputes.

If you have an issue, we always appreciate you contacting us first to give us an opportunity to make things right. Please email us as soon as possible at hype@neversink.co.uk with any problems you have.

These terms of sale are governed by Scottish law and wherever you live in the United Kingdom, you can bring claims against us through Scottish courts. If you live in Wales or England, you can also bring claims against us in the courts of the country you live. We can also claim against you in the courts of the country you live in.

Some final important terms to note.

We can transfer our contract with you, so that a different organisation is responsible for supplying your product. We’ll tell you in writing if this happens and we’ll ensure that the transfer won’t affect your rights under these terms of sale. If you’re unhappy with the transfer you can contact us to end the contract within 7 days of us telling you about it and we will refund you in accordance with these terms of sale any payments you’ve made in advance for products not provided to you.

You can only transfer your contract with us to someone else if we agree to this. We may not agree unless there are exceptional circumstances that mean you have to transfer your contract to someone else.

These terms of sale are a contract between you and Never Sink Limited. Nobody else can enforce it and neither of us will need to ask anybody else to sign-off on ending or changing the contract.

If a court of law invalidates parts of these terms of sale, the rest of it will still apply. If a court or other lawful authority decides that some of these terms are unlawful, the rest will continue to apply.

Even if we delay in enforcing these terms of sale, we can still enforce it later. We might not immediately investigate and follow-up on something you have not done, such as making a payment, or for doing something you’re not allowed to, but that doesn’t mean we can’t do it at a later date.
